Manuscript of the ‘Regiam Maiestatem’, statutes, burgh and guild laws, ‘Quoniam attachiamenta’, forest laws, ‘De judicibus’, and other smaller legal texts, some in Scots, mostly written by James Monynet in 1488, with some later additions.

Scope and Contents

The contents of the manuscript are as follows:

(i) Table of sections (iii) and (v)-(vii) (folio vi).

(ii) ‘Brevis ordo judiciarius,` maxims and procedures in 12 chapters, in a later hand (folio x verso).

(iii) `Regiam Maiestatem,` in four books of respectively 35, 74, 35, and 68 chapters (folio 1). In addition to this numbering (in red) there is a continuous numbering of the chapters to ccxi. Prefixed are 11 lines beginning `Hoc trahit ad lumen antiqua statuta volumen’ (‘Acts of the Parliament of Scotland’, i, page xv). ‘Acts of the Parliament of Scotland’, i, pages 233-277.

(iv) Four chapters, the first two numbered ccviii and ccviiii, the others in a later hand and in Scots, on various topics (folio 59 verso).

(v) `Quoddam notabile de maritagio` in 18 chapters (folio 63).

(vi) `Statuta Regis Malcolmi Mackynneth` in 3 chapters numbered 19 to 21 (folio 66).

(vii) ‘Statuta prima Regis Roberti Broys` in 19 chapters (folio 66).

(viii) `Statuta Regis Willelmi` in 11 chapters, with table at the beginning (folio 69). ‘Acts of the Parliament of Scotland’, i, pages 47-61.

(ix) `Constituciones Willelmi Regis` in 19 chapters, with table added later in the lower margins of folios 70 verso and 71 recto (folio 71).

(x) Statuta Alexandri Regis filii Willelmi Regis` in 29 chapters, with table at the beginning (folio 75). ‘Acts of the Parliament of Scotland’, i, pages 65-74.

(xi) `Statuta secunda Regis Roberti Broys` in 34 chapters (numbered in red only to xxvii, the remaining numbers added later), with table at the beginning (originally of only 26 chapters; the remainder added later in the lower margin of folio 83 verso) (folio 83). ‘Acts of the Parliament of Scotland’, i, pages 107-114.

(xlviii) `Þe buikis tretis processis and lawis contenit within þis volume of Regiam Majestatem and the Kingis lawis ordourly`, in a later hand (folio 400).

Headings and initials are in red. The scribe gives his name and the date on folio 59: `Et sic est finis tocius regie majestatis scripte per me Jacobum Monynet xxixº die mensis Junii anno domini millesimo quadringentesimo octuagesimo octavo.` `Per Jacobum Monynet` or `Per Ja M` also occurs on folios 59 verso, 318 verso, and 385. Several slightly later hands have added sections (ii), (iv) (second part), (xxv), (xxvi), (xxxix), and (xliii)-(xlviii) ((xliii), (xlv), (xlvii), and (xlviii) are in the same hand). There are frequent marginal annotations in various hands. On folio iv verso are notes in Latin on the calculation of the date of Easter, and on folio iv verso notes in Latin and English on the phases of the moon.

Paper (watermarks: gatherings a, 16, insert in 19, 23-24, 26, 30-32 various forms of gothic P, cf. Briquet 8625, 8573-8581, 8544, France and Low Countries, late 15th century; gatherings 1-6, 17-19 two types of pot, cf. Briquet 12476-12477, 12620, France, 1470s and 1480s; gatherings 7-15, crowned heart, cf. Briquet 4324-4326, Low Countries, late 15th century; gatherings 20-22, 25, 27-29 eight-pointed star, cf. Briquet 6055, France, 1461). Binding of full leather, tooled gilt with Advocates` Library stamp, 1798.

Custodial History

The following names of owners appear: Mr David Dun, burgess of Edinburgh (folios v, 157, 399 verso, 401, all deleted), Sir William Saint Clair of Roslin (folio vi), Thomas Nicolson, Commissary of Aberdeen (inscription and printed label, folio vi). Denmilne number (48) is on folio v verso and Sir James Balfour`s cipher on folios 400 and 401. The manuscript was number 90-107 in the sale of his books in 1698. Former pressmark: A.1.28. The manuscript was bought by the Advocates’ Library in 1698.

Immediate Source of Acquisition

Presented, 1925, by the Faculty of Advocates to the nation on the foundation of the National Library of Scotland.
