Manuscript of the ‘Regiam Maiestatem’, statutes, baron court laws, burgh and guild laws, and some other legal texts, all in Scots, written by one A de D probably in the 1470s.

Scope and Contents

The manuscript is imperfect at the end; and sections (i) and (ii), which belong after section (xvii), have been misbound.

The contents are as follows:

(i) `Statuta regis Jacobi secundi` (folio 1). The beginning is lost; see section (xvii). ‘Acts of the Parliament of Scotland’, ii, pages 31-52.

(ii) `Ye statutis of ye law of march mayd be erll villȝham of Douglas`, 1448 (folio 3). ‘Acts of the Parliament of Scotland’, i, page 350.

(iii) `Regiam Maiestatem` in four books of respectively 41, 70 (73 in the table), 23 (22 in the table), and 43 (41 in the table) chapters, with tables before each book (folio 6). ‘Acts of the Parliament of Scotland’, i, 233-277.

(iv) `Ye lawys mayd be Kyng Vilȝham`, in 14 chapters, with table at the beginning (folio 57 verso). ‘Acts of the Parliament of Scotland’, i, pages 47-61.

(v) `Ye lawys of Kyng Alexander ye sone of Kyng Vilȝham` in 36 chapters, with table at the beginning (folio 60). ‘Acts of the Parliament of Scotland’, i, pages 65-74.

(vi) `Ye lawys mayd be King Robert ye bruce` in 15 chapters, with table at the beginning (folio 68). ‘Acts of the Parliament of Scotland’, i, pages 107-114.

(vii) `Ye statutis off gud King David` in 17 chapters, with table at the beginning (folio 71 verso). Only fragments of chapters 7-11 are preserved because of damage to folio 72. ‘Acts of the Parliament of Scotland’, i, pages 3-13.

(viii) `Ye statutis of Kyng Malcom McKeneth` in 6 chapters, with table at the beginning (folio 74). This is not the text usually so entitled, but proceedings concerning debt.

(ix) `Ye forme and the maner of court baroune and ye attaychmentis wyth ye statutis yeroff folowand` in 37 chapters, with table at the beginning (folio 75 verso). Despite what is said on folio 76, this is not the text usually entitled `Quoniam attchiamenta`. Some text is lost (folios lost after folios 77 and 80).

(x) `Ye prosses off ye breyffis be cours of law` in 6 chapters (folio 93).

(xi) `Ye burrow lawys off ye realm of Scotland` in preface and 126 chapters (numbered only to 122; 115 only in the table), with table after the preface (folio 97). ‘Acts of the Parliament of Scotland’, i, pages 17-44.

(xii) `The lawys of the gyld` (folio 122). ‘Acts of the Parliament of Scotland’, i, pages 89*-96*.

(xiii) `Ye statutis of ye burowys`, part of the collection usually entitled `De Judicibus` (folio 123 verso). Some text is lost (folio lost after folio 124).

(xiv) `Ye forme of ye halding of ye chavmerlayn are and of ye accussyng of crafts wythin ye kings burgh` in 26 chapters (25 in the table), with table at the beginning (folio 125 verso). Chapters 14-21 and the end are lost (folios lost after folios 129 and 131). Chapter 26 is `Ye assis of Kyng David of Veits and messouris`. ‘Acts of the Parliament of Scotland’, i, pages 329-338.

(xv) The laws of ships in 20 chapters (folio 132). Chapters 1-4 are lost (folio lost after folio 131).

(xvi) `Ye statutis of Kyng James ye fyrst` (folio 134 verso). The end is lost (folios lost after folio 140). ‘Acts of the Parliament of Scotland’, ii, pages 1-24.

(xvii) Statutes of James II (folio 141). A fragment; the end is section (i). ‘Acts of the Parliament of Scotland’, ii, page 32.

(xviii) Statutes of James III (folio 143). Only fragments for 1471 survive; folio 143 should follow folio 144. ‘Acts of the Parliament of Scotland’, ii, pages 83-184.

Initials and chapter numbers are in red. The scribe gives his initials on folio 57 verso: `per manum A de D.`

Collation: 1 (5 leaves), 2-7, 8 (-2, 6), 9, 10-11, 12 (-5, 11), 13 (-2), 14 (3 leaves). Catchwords in the inner lower margin of the last verso of each gathering. Ruling mostly with a hard point, occasionally in ink. 1 column. 29-34 lines. Ruled area 210 x 140 millimetres.

Paper (watermarks: gatherings 1, 10, 11 unidentified; gathering 2, 11-14 fleur-de-lys in shield surmounted by cross, cf. Briquet 7219-7220, France, 1475-1476; gathering 2 pot, cf. Briquet 12481, France 1468; gatherings 3-8 coat of arms of uncertain design, cf. Briquet 2015, Britanny 1474; gathering 9 gothic P, cf. Briquet 8615 etc., France 1470s).

Custodial History

The name Jhone Forest(er) of Fotheringame is on folio 89 verso. Former pressmark: A.1.32. The manuscript was acquired by the Advocates’ Library before 1742.
