Manuscript of the Regiam Maiestatem, statutes, Leges Portuum, forest laws, Quoniam attachiamenta, burgh and guild laws, and other smaller legal texts, some in Scots.

Scope and Contents

The manuscript was written by two hands in the second half of the fourteenth century, with one slighly later addition (section (i)) and fifteenth-century additions (sections (ii), (x) etc.). In the fifteenth and sixteenth centuries the volume had East Fife connections.

The contents are as follows. (i) Styles of writs, brieves, etc., in 107 chapters. The majority belong to the reign of Robert II. (Folio 2.) (ii) An alphabetical index to the volume, 15th century. (Folio 17 verso.) Folio 21 blank. (iii) Table of the contents of the volume. The chapters of the various texts are numbered continuously (though the texts from section (vii) on are not here subdivided), with a few variations from those in the margins. The numbering system employed has six scores per hundred. (Folio 22.) Folio 26 verso blank. (iv) 'Regiam Maiestatem' (without title) in four parts (the fourth as well as the third is headed 'tertia pars') of 43, 77, 31, and 62 chapters. ‘Acts of the Parliament of Scotland’, i, pages 233-277. The main text is by two hands, changing at folio 117 verso. The later hand which compiled the index (section (ii)) and added section (x) and tables to sections (viii), (xi) and (xx) has also added miscellaneous chapters on folios 1 and 178 and in the margins throughout. There are also marginal notes in other later hands, especially that of Sir John Skene. These are chiefly legal, but there are four Latin hexameters on folio 152.

Headings are in red. There is an elaborate initial at the beginning of 'Regiam Maiestatem', in red and blue; thereafter initials are plain, alternately in red and blue; there is also some penwork decoration.

Custodial History

On folio 178 verso are records of the purchase of the volume by Duncan Parker from ---Cragy of Edinburgh, 20 Jan. 1424[-5] ('Jacobus Elge ... borgh off hamchalde ... Johne Lusale and Patrick Scot' witnesses. Parker and Elge may be the burgesses of Dundee of those names); and of its sale by Malcolm Lencot(?) to Mr David Meldrum (possibly the official of Dunkeld and later of St Andrews) for £40, 23 May 1469.

The manuscript was later in the possession of Mr John Dalgleish (possibly the graduate of St Andrews in 1554), on loan from Patrick Kynnynmonth of Callinche (inscriptions on folio 2 and passim, sometimes deleted).

In 1565 it belonged to William Skene, Commissary of St Andrews (inscription on folio 17), and later to his brother Sir John (inscription on folio 1 verso), who made much use of it for his edition of the 'Regiam Maiestatem' (Edinburgh, 1609), apparently beginning in 1575 (note on folio 26 verso). Reference is made in the description of it in ‘Acts of the Parliament of Scotland’, i, to a tradition that it descended to the Marquesses of Bute from Sir George Mackenzie of Rosehaugh. It remained in their library at Mount Stuart (and hence is referred to as the 'Bute Manuscript') till 1987. On folio 178 verso are a variety of names and notes, including Alexander Winchester and William Carstairs, 16th century, and an earlier anathema.
